The proposed regulations for the use and distribution of judgment funds under the Indian Judgment Funds Act of 1973 would exclude the investment of the funds in corporate bonds. This would be prohibiting the tribes from investing in assets that practically every private investment counselor recommends. Furthermore, the proposed regulations would be denying private industry a substantial source of funds from which to borrow. Therefore, the author urges the regulations be amended to permit Indian tribes to invest judgment funds in corporate bonds through private trusts.
