The author is writing to Cecil d. Andrus, the secretary of the department of the interior, concerning a loan that was guaranteed by the bureau of Indian affairs (Bia) but which has now gone into default. The author understand that the Bia is refusing to reimburse the American Indian national bank (AIN) for the loss, on the grounds that the loan should never have been made in the first place. However, the author argues that both the AIN and the Bia had responsibility for ensuring that the loan was a good risk, and that the only grounds on which the Bia can legally refuse to reimburse the bank is if there was fraud or material misrepresentation involved in the loan process – neither of which, the author contends, is the case here. The author asks Andrus to look into the situation and to make a decision as quickly as possible.
