This memorandum discusses the jurisdiction of tribal and federal authorities over trust lands of the Cheyenne-Arapaho Tribes of Oklahoma. It clarifies that Indian allotments are considered Indian country over which the tribes and the United States have jurisdiction. It also explains that a previous court decision regarding jurisdiction over allotments in Oklahoma was based on an outdated law and that Congress has since amended the law to apply in Indian country. The memorandum recommends that the Cheyenne-Arapaho Tribes be certified for law enforcement functions and that denial of funding should not be based on jurisdictional issues.
