The Menominee Restoration Committee is seeking clarification on two issues regarding the Menominee Restoration Act. They argue that the Act does not require new enrollees to be born in Menominee County and that descendants of individuals improperly excluded from the 1954 roll should be allowed to enroll. They believe that the Restoration Committee, not the Secretary, has the authority to prepare the roll and make interpretative rulings. The legislative history supports their position, and they argue that any prior inconsistent statutes or regulations should be repealed by implication.
