The U.S. Department of Labor is responding to a request from the Oklahoma Insurance Commissioner regarding the preemption of state regulation for a self-insured trust called DIG that provides health benefits to members of the International Union of Petroleum Workers. The Department determines that DIG does not constitute a MEWA and is not preempted under ERISA, assuming it is maintained pursuant to collective bargaining agreements. Additionally, the Department concludes that DIG qualifies as an "employee welfare benefit plan" under ERISA.
